Position Summary

The attorney in this position will be part of the Marriott Law Department. This position will provide legal services in the area of business ethics and legal compliance. The Shanghai office is a preferred location.

The attorney in this position is an integral member of the Legal Compliance team and will provide legal support to Marriott businesses and activities with respect to the Company’s strategic Legal and Ethical Compliance program which includes the Business Conduct Guide, the Business Integrity Line and compliance with regulatory requires in Greater China. This attorney will provide crucial subject matter guidance for the following key compliance risk areas:

  • PRC compliance and anti-corruption regulations and enforcement, including SOE compliance;

  • Anti-corruption and anti-bribery, including the Foreign Corrupt Practices Act (FCPA) and the UK Bribery Act;

  • Office of Foreign Assets Control (OFAC) and economic sanctions laws, as well as geopolitical anti-sanction countermeasures

  • Antitrust and competition law;

  • Anti-money laundering;

  • White-collar crime;

  • Business ethics;

  • Sensitive internal investigations;

  • Third-party due diligence; and

  • Other critical areas as designated from time-to-time by the Law Department and Chief Legal Counsel to support the Company’s business in Greater China

Specific Job Summary and Expected Contributions

  • Monitor and research the evolving PRC and regional statutes, regulations, and enforcement cases and help to identify regulatory development of critical importance to the enterprise-wide Legal and Ethical Compliance Program in a global hospitality company doing business in Greater China;

  • Prepare research products to support the Chief Legal Counsel on the legal and ethical compliance issues;

  • Advise complex and significant internal investigations resulting from allegations of potential violations of business ethics as well as government requests/inquiries;

  • Guide APAC Fraud Committee on matters of fraud, internal control and business ethics, and provide training and guidance on best practices;

  • Manage significant legal investigations including resource planning, outside counsels, and internal communications; 

  • Conduct briefings of senior executives and provide guidance and support on accountability and remediation;

  • Advise on the most significant enforcement actions and respond to government investigations or queries as appropriate and/or required;

  • Identify urgent legal and ethical compliance issues of material concern to the Company and work with leadership to identify appropriate direction and courses of action;

  • Develop, draft, promulgate and maintain policies, standards and procedures in the key risk areas and work cross-functionally with stakeholders to integrate these policy requirements into global operations;

  • Conduct, guide and participate in legal and ethical risk assessments; develop risk mitigation plans and make recommendations on the appropriate financial investment to accomplish the policies and implement the procedures;

  • Monitor and assess the effectiveness of compliance activity and facilitate auditing;

  • Maintain strong coordination, cooperation and mutual support between the Law Department and other corporate departments with compliance obligations such as Internal Audit, Finance, Global Development, Global Investigations, IT, the Corporate Secretary’s Office, Government Affairs, Human Resources, and the regional Legal and Ethical Compliance Councils (LECCs) to ensure that roles and responsibilities are effectively fulfilled in the Company’s Legal and Ethical Compliance Program;

  • Develop legal training contents and conduct legal training in both English and Chinese to sustain the Company’s confidence in local compliance and to ensure vigilance against non-compliance with a strong focus on the US FCPA, UK Anti-Bribery Act, OFAC, antitrust laws, and PRC compliance regulations in all relevant jurisdictions;

Candidate Profile

Successful candidates should possess education and experience as follows:

  • Excellent academic records with a law degree from a top law school in PRC;

  • PRC bar qualification, or admission to the bar of a US state or its equivalent abroad;

  • 7-10 years’ substantial legal experience in compliance work, white-collar crime investigation, regulatory litigation, or corporate internal investigations in PRC;

  • Outstanding analytical, writing, and presentation skills in both English and Chinese;

  • Experience interfacing with government agencies having jurisdiction over compliance matters;

  • Broad background in providing advice and counsel to operating business managers on legal and ethical compliance matters with a focus on individual integrity and principled business conduct;

  • Demonstrated ability to take ownership of and solve problems, and to expeditiously provide recommendations which are consistent with sound and ethical business practices, and common sense;

  • Highly collaborative and team player

  • Ability to think creatively, to supervise multiple and complex matters, and to work independently and effectively with clients, peers, and other parties;

  • High degree of competence and familiarity with computers and the internet;

  • Strong quantitative and qualitative analysis skills; ability to take large volumes of complex information and present it in a clear and concise manner;

  • Outstanding strategic planning and management skills;

  • Ability to integrate and balance priorities, work activities and resources for the benefit of multiple key stakeholders;

  • Strong performance management skills;

  • Active learner -- able to enhance personal, professional, and business growth through new knowledge and experiences; and

  • Available for business travel.
